A PROPERTY dispute over an extensive set of buildings in the heart of Lymm has taken a new turn.

The land was home to an acrimonious business failure - and the total value of the site could be in excess of £1m.

A restriction has now been imposed on the sale of the land, which includes the shop front occupied by Harvey World Travel and around 12 apartments behind it.

The key players are former business partners Bob Green, from Birchdale Road in Appleton, and Stockport businessman Thomas Kynaston.

They ran Mossley Travel, which traded from the shop front until 2003.

The shop front and land with the apartments has been registered with Thomas Kynaston, aged 62, and his son Daniel, aged 39, from Lymm, since 2001.

But Mr Green has now had his interest in the property recognised by the Land Registry.

"The Kynastons agreed to retract their objections to the registration of Mr Green's interest shortly before a Land Registry hearing," said Mr Green's solicitor, Parveen Bunglawala, of Davies Ridgway Solicitors on Bold Street.

"The next step is for us to enter into negotiations with the Kynastons.

"The impending negotiations will be centred around the acknowledgement of Mr Green's interest, which is manifest from the Kynastons' retraction of objections and, crucially, the extent of his beneficial entitlement.

"He is entitled to financial recompense for his share in this substantial area of land and buildings."

Mr Green's solicitors argue the whole property was bought by the business partnership - and therefore partly owned by Mr Green.

The land is roughly shaped like a letter P', with the shop front at the base. It extends back around 50 feet and almost to the Bridgewater Canal.

The Warrington Guardian understands that there are around 12 flats being rented out at £500 to £600 a month, in addition to the business premises at the front. Miss Bunglawala said it was difficult to assess the value of the property without access.

Land Registry documents show that the property, which is in two titles, was bought by Daniel and Thomas Kynaston for £200,000 in 2000 and 2001.

The previous owner was Rexbray Ltd, a construction company in which both Kynastons were directors.

Rexbray was put into compulsory liquidation in August 2003.

Harvey World Travel and the Kynastons' solicitors, the Thrasher Walker Partnership of Stockport, did not comment.
