A CUDDINGTON-based housing developer has spoken out to refute claims its work in Weaverham is not progressing to plan.
Anaconda Investments was granted permission to build 14 homes at the corner of Wallerscote Road and Northwich Road despite previously being refused on the grounds of over supply of housing in the area.
But Peter Faulkner, Vale Royal Borough Council planning compliance officer, said the company must now submit a new application to the planning authority by tomorrow, Thursday, or face enforcement action.
The move comes after a Church Lane resident raised concerns that properties were being built closer to their existing home than original plans stated. It was also claimed two trees, which formed part of their property boundary, had been removed without consent.
Anaconda spokeswoman Ruth Elliott-Smith denied suggestions the properties are about three metres closer than originally planned.
She said: "There is nothing new in these claims. They were raised two years ago and again at the appeal and subsequently dismissed as insufficient grounds for refusal by the inspector."
Ms Elliott Smith said the rear elevation of the development was in line with stipulated measurements. She added: "Peter commissioned a survey which shows the boundary hedge at the rear of Block A and made his measurements from that.
"It does not show the position of the boundary as drawn on the OS Plan (legal boundary) which appears on the approved plan and which is further away. He is measuring from the wrong boundary and that is why his measurement is wrong."
Ms Elliott-Smith said building work is continuing at the site and no new application will be submitted.
