AN ‘aggressive’ man booted police officers who attended his home to arrest him.

Dominic Spencer lashed out at the male officers, injuring one of them while the pair were simply exercising their public duty.

The 28-year-old was arrested and later charged with assault occasioning actual bodily harm, assault by beating of an emergency worker and two counts of obstructing an officer.

He admitted the offences at an earlier hearing before Warrington Magistrates’ Court, with the case adjourned for the preparation of a pre-sentence report.

A new date for sentence was listed for recently, and this proceeded without the assistance of a report, as it was heard that the Probation Service was unable to prepare one due to the defendant’s ‘aggressive attitude’ while interviewing him.

The court heard how at 12.50am on Tuesday, September 3, officers from Cheshire Police attended Spencer’s home address on St Elphin’s Close in Howley.

This was in relation to a report of criminal damage, explained Alex Farrow, prosecuting, whereby Dominic Spencer was a named as a suspect.

On arrival, Spencer invited the officers into his address, and while inside, an officer placed him under arrest.

However, he started to remonstrate and resisted arrest while an officer attempted to apply handcuffs.

Spencer then kicked the two male two officers, causing them both to fall onto the bed.

Having heard the facts of the case, magistrates ruled that the severity of the offending meant that the case had crossed the custody threshold.

It was said that Spencer launched an ‘unprovoked attack of a serious nature’, and that he caused serious injuries to officers simply doing their job.

However, taking his guilty pleas into account, and after hearing that the defendant would lose his house and job if he was sent to prison immediately, the sentence was suspended.

Spencer was sentenced to 18 weeks in prison, but this was suspended for two years, and he was ordered to pay compensation to the officers of £300.
