AN abusive controlling thug could face further jail time for attacking his former partner while currently serving a sentence for a separate attack.
Nathan Modlinsky, from Leigh, was described as ‘jealous’ and ‘toxic’ during his relationship with his latest victim from Warrington, who bravely appeared in court to hear his sentencing.
After knowing each other for several years the couple began a relationship in 2018 but the court heard how it soon began to ‘deteriorate’ and was constantly marred with Modlinsky’s ongoing accusations of his partner cheating.
The defendant appeared before Liverpool Crown Court last Friday, February 24, facing one charge of bodily harm.
Prosecuting, Ben Berkson said there was a theme of control issues that ran throughout the relationship with his behaviour getting worse whenever the defendant drank.
The court heard how on one occasion the abusive behaviour got so bad that his victim attempted to take her own life.
The relationship between them continued and so did Modlinsky’s paranoia.
On November 18, 2020, he assaulted his victim outside a shop on Norris Street in Orford.
The court heard how he punched his victim and dragged her to her feet along the road before wrapping his hands around her throat.
Two witnesses saw the violent incident occur in horror and Cheshire Police were called.
When the officers arrived, the victim had visual injuries and disclosed to them how the defendant had demanded that she hold his hand in public or ‘he would slap her’.
The defendant joined the court hearing via a video link, having been serving a sentence for a similar incident where he violently attacked and abused another victim in a relationship that began shortly after this one had ended, in the spring of 2020.
The sickening individual reportedly ‘punched, kicked and strangled’ the victim, as well as in one disturbing incident began ‘pushing his fingers down her throat’ and threatening to kill her.
He pleaded guilty to two counts of assault causing bodily harm and was given three years during his sentencing at Bolton Crown Court in October last year.
The brave victim during this recent case provided an emotional statement that was read out to the court - one she had to hear back with the support of her family members in the stands.
It said: “I feel like I live in a daily battle with my mental health.
“My sleep has been massively affected. I have never suffered anything like this,” she said.
“I can barely hear in one ear due to injuries I have suffered.
“I feel ugly, there is a scar through my eyebrow.”
The victim proceeded to say how she now struggles with birthdays because they bring back trauma and bad memories.
“Nathan has ruined everything about me. I don’t think I will ever feel normal again.”
The victim now suffers with terrible anxiety due to the appalling treatment she faced at the hands of the defendant.
She concluded: “Nathan has robbed me of my future, he has taken so much from me.”
Aggravating factors that were read out to the court included the vulnerability of the victim as well as the element of strangulation and psychological and physical harm that was caused to the victim.
The case was adjourned due to a pre-sentence report but the offender is likely to face a further custodial sentence on top of his current one.
The trial proceedings are to continue on March 16.
