A THUG has been locked up after he struck his victim over the head from behind with a glass bottle.
Billy Julious committed the offence after he became involved in an argument with the complainant in the town centre.
According to the judge who jailed him, it was only a ‘matter of luck’ that he did not suffer more serious injury in the cowardly attack.
The 22-year-old defendant appeared for sentence before Liverpool Crown Court after pleading guilty to a charge of wounding.
Mike Stephenson, prosecuting, explained to the court how the victim in this case was a man in his mid-30s, who was known to the defendant when the incident occurred on the evening of August 9 this year.
At around 8pm, he was with a group of friends under the bridge near Warrington Central train station when Julious approached him.
There was a conversation between them regarding a family member of the victim, which soon turned into a row.
The court heard how Julious was ‘very animated, appeared to be intoxicated and possibly under the influence of drugs’.
The victim told him to stay away from the family member under discussion, before the defendant walked away.
But he soon after ran back towards the victim from behind and struck him to the head with ‘something shiny’ which he had picked up off the street, which was later revealed to be a glass bottle.
The strike caused ‘quite a nasty cut’ measuring several centimetres in length to the back of his head.
The court heard the wound was ‘bleeding profusely’, resulting in an ambulance being called.
Fortunately, the cut did not require stitches, however it was so severe that it needed to be glued.
Julious was arrested shortly after following a short chase by police and gave no comment during his police interview.
Mr Stephenson detailed to the court the defendant’s previous convictions, which include hitting a man with a broken guitar in April last year, causing scratches and reddening.
In June this year, he was sentenced to 70 days in prison for a malicious communications offence, where he started an Instagram live story of himself with his face smeared with blood shouting that he was going to cut someone’s throat and urinate on the door of a flat.
He was out of prison on licence for this crime when he committed the wounding offence on August 9.
In defence of his client, Adam White spoke of Julious’ ADHD diagnosis, which he asked the court to take into account.
“He is a young man of 22, and his behaviour, not just on this occasion but in previous incidents, is indicative of a rather immature approach to life,” he said.
“He fails to properly recognise the implications of his actions, which was a significant issue here as he did not think through how serious it was.”
Mr White explained how Julious moved up to Warrington from Kent as had entered a relationship with a family member of the victim, but this relationship fell apart.
“He has clearly demonstrated remorse with his early guilty plea, for which he is entitled to full credit,” he added.
“He is someone in the right circumstances who can engage with the probation service and turn things around.”
But this was not enough to persuade judge Garrett Byrne from sparing the defendant an immediate prison sentence.
He said: “You have a pattern of hitting people with weapons in public and you have shown no real victim empathy or understanding of the impact of your offending.
“This was a serious incident where you return to the complainant having armed yourself with a weapon before striking.
“It was only a matter of luck more serious injury was not caused.”
Julious, of no fixed abode but previously from Gillingham in Kent, was sentenced to 12 months in prison.
