A FEARNHEAD biker caught speeding at 105 mph on a 60mph by-pass in North Wales has avoided a ban.
Stanley Kim Brown, of Cinnamon Lane, told Flintshire Magistrates’ Court on Thursday that he would not be able to continue his work as a self-employed plasterer if the disqualification was enforced.
The court heard how the 62-year-old was caught by police using a laser device while riding a Triumph motorcycle at 105 mph in a 60 mph area at 10.40am on June 7.
Prosecutor Brian Robinson described the speed as unacceptable.
Brown, of Cinnamon Lane in Fearnhead, Warrington, had previously pleaded guilty to the speeding charge by replying to a letter but he was asked to attend a court hearing so that a disqualification could be considered.
Prior to the incident, Brown had a clean licence and had been driving for 45 years at the time of the incident.
Brown, who represented himself, recalled how he had been travelling behind two cars driving at 40 mph 'for ages'.
When the lane was clear he decided to overtake and 'get out of the way', the court heard.
But as he was doing so the car ahead of him pulled out to overtake the first car so he pulled back in behind the two cars.
When he could, he decided to overtake that car but he said the car driver continued to accelerate.
Brown accelerated to overtake the car but when he looked down at the clock he saw that he was ‘doing stupid speeds’.
Magistrates said that he had been candid as he had accepted that it was an excessive speed.
Considering his personal circumstances and his driving record they decided not to ban Brown from driving.
Brown was fined £250 with £85 costs.
He was also ordered to pay a £25 surcharge and the criminal court charge of £150.
